Welcome to Lucky Races. These Terms of Service ("Terms") govern your access to and use of the Lucky Races game, website, and related services (collectively, the "Service") operated by Lucky Machines LLC ("Company," "we," "us," or "our"), a California limited liability company.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction.
Lucky Races is a fully on-chain multiplayer racing game. The Service allows you to:
The Service offers two ways to play: (a) using a custody wallet managed on your behalf by the Service, or (b) connecting your own external Ethereum wallet. If you use a custody wallet, we manage the underlying wallet infrastructure but you remain responsible for securing your account credentials. If you connect your own wallet, you are solely responsible for maintaining the security of your wallet, private keys, and seed phrases. We do not have access to external wallet private keys and cannot recover them if lost.
All on-chain transactions (including but not limited to joining lobbies, submitting race turns, and interacting with game smart contracts) are executed on the Ethereum blockchain and are irreversible. You acknowledge that:

We reserve the right to restrict access to the Service for any user who violates these Terms or engages in behavior that is detrimental to the game or its community.
All content, code, designs, artwork, trademarks, and other intellectual property associated with Lucky Races and the Racerverse™ are owned by Lucky Machines LLC or its licensors. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.
Ownership of in-game NFT assets (such as Original Racers) is governed by the applicable license terms provided at the time of acquisition. Owning an NFT does not grant ownership of the underlying intellectual property.
You are responsible for all activity that occurs under your account or wallet address while using the Service. You agree to use the Service in compliance with all applicable laws and these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that smart contracts will perform as expected under all conditions. Use of the Service is at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUCKY MACHINES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR DIGITAL ASSETS, WHETHER CAUSED BY TORT, BREACH OF CONTRACT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
This includes, without limitation, damages arising from failed transactions, gas fees, smart contract exploits, wallet compromises, network congestion, or loss of access to digital assets.
You agree to indemnify and hold harmless Lucky Machines LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We may also update these Terms from time to time. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
